In its second amended complaint, JGR accused a Spire staffer of informing a JGR employee that Gabehart was in charge of or significantly involved in Spire’s racing strategy. It stated that employees were instructed to keep Gabehart’s role confidential and that such conduct breached Gabehart’s non‑compete obligations. The court accepted JGR’s motion, noting the team lacks non‑privileged evidence to back the claim. The allegation was formally struck from the docket.

Privileged Data Disclosed – A New Twist

While JGR’s claim fell away, Gabehart’s attorneys now argue that JGR’s forensic examiner repeatedly opened and shared his private attorney‑client emails before JGR counsel could lawfully access them. The data breach allegedly violated an April 22 protocol and the attorney‑client privilege, forcing Gabehart to incur extra legal costs. JGR, for its part, says the scrutiny of Gabehart’s accounts uncovered wrongdoing, but the discovery of privileged material undermines its own case.

Gabehart contends that JGR illegally withheld salaries and bonuses when his responsibilities shifted from the agreed scope. According to him, JGR paused payments, launched a forensic review, then pressed a lawsuit, and finally sent a “for‑cause” termination letter based on the same conduct the investigation found cleared him. JGR’s Terminational Payroll Notice lists the reason as “Voluntary Resignation,” while Coach Gibbs publicly described the exit as a joint decision.

Spire’s Counterclaims and the Cheddar Smith Deal

Spire and co‑owner Jeff Dickerson accuse JGR of bad faith, alleging that JGR targets rival teams with lawsuits but never seeks confrontation. Dickerson points to JGR’s recent hire of Toyota‑aligned crew chief Robert “Cheddar” Smith, who was under Spire contract and was released to join the No. 54 Ty Gibbs squad. Dickerson says JGR had already approached Smith and only offered a trade in 2025, which Spire did not accept. The firm requested a $100,000 settlement instead of a personnel trade; the offer was denied.

In its countersuit, Spire details three categories of claims. The first alleges an enforceable oral contract that spurred Spire to release Smith, and that JGR breached by refusing equivalent personnel or a payment. The second presents the same bargain as an implied contract based on parties’ conduct. The third accuses JGR of unjust enrichment for keeping Smith after the agreed release.
